Definitions
"User" means the person or entity using the website.
"Owner" means the company that owns the website, Claesens Australia
"Service Provider" means the company providing the website content management system and hosting services to the Owner for the website.
"Website" means "http://shop.claesens.com.au/"

This web site is owned and operated by mila & milo pty ltd (trading as Claesen's Australia) at PO Box 2060 Hawthorn VIC 3122 and registered company (ABN 22 114 121 925).

These Terms and Conditions form a legal agreement between you (the "Customer") and Claesen's Australia. 
"Products" means the goods described and supplied for sale on the Claesen's Australia website.
An "order" constitutes the products that are selected by the Customer to purchase for the stipulated price.
"Delivery Charges" means all postage and handling charges associated with the delivery of goods to the Customer.

It is important that these Terms and Conditions are read and understood. In the process of accessing, using and placing an order on this website you are deemed to have accepted these Terms and Conditions and are therefore legally bound by their content.These Terms and Conditions are subject to change without notice whereby these amendments are deemed to be effective immediately.These Terms and Conditions are governed by and adhere to the laws under the jurisdiction of the courts of the Australian State of Victoria.


Conditions of Sale

Any person who enters into a transaction with Claesen's Australia must be of legal age, 18 years and over otherwise they are prohibited under law and these Terms and Conditions.

All prices for products offered for sale on this website are shown in Australian Dollars ($AUD) and include Goods and Services Tax (GST).  The sale of goods includes payment of delivery charges plus GST in respect to the products ordered. Prices shown on the website are subject to change without notice.  When a person enters into a transaction on this website Claesen's Australia will honour the price quoted at the time of purchasing.

Claesen's Australia does not accept responsibility for custom charges incurred on goods when delivery to countries outside of Australia.  Each country is bound by their own import charges.  Please contact your local custom's office for information pertaining to these custom charges.  All custom charges are the sole responsibility of the Customer.


Purchase of Goods

An order placed by the Customer via this website is a commitment to purchase products from Clasesen's Australia at the represented price inclusive of GST and all delivery charges. It is at the sole discretion of Claesen's Australia to accept or reject an order placed by a Customer via the website.  An order is only considered accepted and a transaction entered into between the Customer and Claesen's Australia once it has been confirmed and payment for the products has been approved and received in full.

Claesen's Australia accepts payment via VISA and Mastercard credit cards as well as Pay Pal. The Customer can shop on-line with the reassurance of knowing that all credit card transactions are made on a secure page on our server via the SecurePay Gateway. Pay Pal is a secure third party payment site and the Customer must hold a Pay Pal account to use this payment method.  The Customer can easily set up a Pay Pal account by visiting www.paypal.com.au.

However, should the Customer wish to place an order but does not wish to pay via VISA, Mastercard or Pay Pal because they are not willing to send credit card details over the internet please do not hesitate to contact us on +613 8862 8700 or email info@claesens.com.au to organise alternate payment options.


Delivery

All deliveries to the Customer will be made by Australia Post , TNT Australia or TNT International.
The Customer should allow approximately 3 - 5 business days from the date payment is received by Claesen's Australia, for the processing and dispatch of the order. Please allow approximately 5 - 7 business days from the date of dispatch, for delivery of the order within metropolitan areas within Australia and approximately 7 - 14 business days for regional areas within Australia and overseas deliveries. Should the Customer require more urgent delivery of an order, please contact us on +613 8862 8700 to arrange for an express courier service delivery.  This service will incur an additional charge and all delivery charges will be provided via a quotation to the Customer.

Claesen's Australia uses third party freight handling companies and therefore will accept no responsibility for delivery of goods once the order has been dispatched to the freight contractor. Claesen's Australia is not responsible for late, lost or stolen deliveries or damaged products resulting from delivery by the freight contractor.

It is important that the Customer provides correct delivery address details as Claesen's Australia takes no responsibility for any undeliverable orders and or re-delivery of orders and their associated costs. However, Claesen's Australia values their products and the Customer and every effort is taken to ensure due care and timely delivery of all orders.

Custom Charges incurred for deliveries of orders internationally are the responsibility of the Customer.  These import duties and taxes vary between countries and the Customer is advised to contact their local Custom's Office for more information. Please refer to our Shipping  information  for further details in respect to delivery of orders within Australia and internationally.


Product Design & Quality


Claesen's Australia is the exclusive importer, wholesaler and distributor of the Claesen's brand in Australia.  From time to time the product that is received by the Customer can change slightly from the image represented on the on-line  store. This can be due to different fabric dye lots or slight variation in design. Claesen's Australia takes the utmost care to ensure any variations are minimal and that the product advertised for sale is the same as the actual product the Customer receives. However, Claesen's Australia accepts no liability for such differences. Claesen's Australia has made every effort to represent the Claesen's products truly but cannot take any responsibility for the Customer's computer hardware and how the product may appear via way of their monitor. Claesen's Australia accepts no liability for any variations to the product resulting from these circumstances.


Retention of Title

The products remain the sole property of Claesen's Australia until full payment for has been received for the order.


Intellectual Property

All content on this website including, but not limited to, the written material, the logo, design, layout, look, appearance, product and lifestyle images are owned or bound by copyright to Claesen's Australia and/or Claesen's International B.V. It is expressly prohibited to reproduce, transmit, copy or use any of the content on this website unless authorised by Claesen's Australia. Any unauthorised use of website content maybe subject to claim for damages, criminal offences or violate copyright law.


Wholesalers


Existing wholesalers are able to order on-line using their secure username and password login. All existing wholesalers who are accessing, using and placing an order on this website are deemed to have acknowledged these Terms and Conditions and are therefore legally bound by their content. Existing wholesalers are provided payment options in accordance with their Terms of Trading Agreement and Credit Application documentation. However, the payment options available when ordering and purchasing on-line are at the sole discretion of Claesen's Australia.

Shipping


Claesen's Australia uses Australia Post Express Post satchels for domestic deliveries, or for larger orders TNT Australia, and for all international deliveries, TNT International.  All these express post services ensure a prompt dispatch and delivery service. Each of these services also provide tracking numbers for every delivery so if the Customer would like to know where an order is please contact us on info@claesens.com.au or +613 8862 8700. Estimated delivery times have been provided by the service provider and cannot be guaranteed by Claesen's Australia.

Australia

All Australian orders are dispatched using Australia Post Express Post service.

Any orders over 20 units will be sent using TNT Australia Road Express Service.  Please go to Freight and Terms in the checkout process to obtain the freight price. Please note that all TNT deliveries may only be made to a business address only and not a PO Box. Any re-delivery fees incurred will be on charged to the Customer. International

Claesen's Australia uses TNT International Express for all international deliveries.

It is a requirement for TNT International Express to deliver to a street address only and not a PO Box. Any re-delivery fees incurred will be on charged to the Customer.

If the Customer does not want to use the TNT International Express service, please contact us at info@claesens.com.au or +613 8862 8700 to make alternative postal arrangements.

Custom Charges incurred for deliveries of orders internationally are the responsibility of the Customer.  These import duties and taxes vary between countries and the Customer is advised to contact their local Custom's Office for more information.


Returns


Faulty Products

Claesen's Australia endevours at all times to ensure excellence in quality control.  However from time to time, products are received from our supplier Claesen's International BV that could be faulty.  If the Customer receives a product that is deemed to be faulty they must contact Claesen's Australia at info@claesens.com.au or call on +613 8862 8700.

The faulty product will need to be sent to the following address:

The Customer will also need to print and complete the following form [RETURNS FORM] and include it with the return of the faulty product. It is at the discretion of Claesen's Australia as to whether the product is deemed to be faulty.  Where this is the case, a replacement product will be sent out to the Customer. However, if it is not possible to replace the faulty product Claesen's Australia will offer a full refund inclusive of all delivery charges.The refund will be in the form of credit to the original method of payment. The Customer must return a faulty product to Claesen's Australia within 30 days from the date of purchase in order to receive a full refund. If on the other hand, Claesen's Australia does not deem the product to be faulty it will be returned to the Customer.

Claesen's Australia does not accept liability for orders that are damaged in transit as responsibility is with the third party freight contractor.

Incorrect Orders

If the Customer has received an incorrect order, either by size, style, colour or quantity, please contact Claesen's Australia at info@claesens.com.au or call on +613 8662 8700.

The incorrectly ordered product will need to be sent to the following address:

The Customer will also need to print and complete the following form [RETURNS FORM] and include it with the return of the incorrectly ordered product. Where possible, Claesen's Australia will replace the incorrectly ordered product with the correct one. However, this may not always be possible due to unavailability of stock at the time. In which case, Claesen's Australia will offer a full refund on the product inclusive of all delivery charges. The refund will be in the form of credit to the original method of payment.

Claesen's Australia will only accept a return of incorrectly ordered products if they are as new, unwashed, unworn and in original packaging with all the labels and tags still attached to the garment.  Claesen's Australia reserves the right to refuse a return or exchange should these requirements not be met.

The Customer has 7 days from the date of delivery to notify Claesen's of any incorrectly ordered product to obtain a full refund or exchange of a product.  Claesen's Australia must then receive the product for return or exchange within 14 days from this date of notification or the offer to refund or exchange will be deemed null and void.

Claesen's Australia will also offer a full refund or exchange of a product should an error have been made by our third party warehousing in their pick and pack processes.  The Customer will not incur any extra delivery charges as a result of this error.  However, should there be unavailability of the correct product a full refund inclusive of delivery charges will be offered to the Customer. The refund will be a credit to the original method of payment.

Sale items purchased through the Claesen's Australia website cannot be returned or exchanged unless deemed faulty.

Claesen's Australia will only be responsible for returns or exchanges on products purchased from this website. If the Customer has purchased a Claesen's product from a retailer, the Customer will need to contact the retailer directly for their returns and exchanges policy.
